OHIO COUNTY, Ky. (5/31/13) – New charges have arisen in the case pending against Ohio County Resident Tony Berkley. In November of 2012, Berkley allegedly chased his daughter, Melissa Jane Berkley, and her boyfriend, Jerry Goodman, on Ky. Hwy. 878 in Ohio County, causing the couple’s car to run off the road into a pond. Both the daughter and her boyfriend drowned in the pond. At the time, Berkley was charged with Wanton Endangerment, but was later indicted on murder charges.
This week, Detective Timothy Hatfield of the Ohio County Sheriff’s Department, submitted new evidence in the case against Berkley, leading to a new indictment accusing Berkley of having a sexual relationship with his daughter. A grand jury has indicted Tony Berkley with Use of a Minor (under 18) in a Sexual Performance, Promoting a Sexual Performance by a Minor(under 18), 2 counts of Sexual Abuse First degree Victim under 18 defendant in position of authority, and five counts of Unlawful Transaction with a minor first degree Illegal sex act. The evidence submitted also accused Melissa Faye Berkley, Tony Berkley’s wife and the mother of Melissa Jane Berkley, of having been involved in these sex acts. In December of 2012, law enforcement executed a search warrant on the Berkley residence, and seized all cell phones and computers on the premises. The electronics were sent to a lab for analysis.
Authorities alleged Melissa Fay Berkley was also found to possess sexual content on her personal computer and cell phone that portrayed her daughter in sexual acts when she was under the age of eighteen. She was indicted on Use of a Minor (under 18) in a Sexual Performance, Promoting a Sexual Performance by a Minor (under 18), Possession of Matter Portraying Sexual Performance of a Minor (Child Pornography), Sexual Abuse 1st degree Victim under 18 defendant in position of authority, and 5 counts of Unlawful Transaction with a minor 1st degree Illegal sex act.
Tony Berkley is currently incarcerated in the Ohio County Detention Center on a $100,000 bond.
