Henderson Man Charged With DUI After Reporting Assault, Theft

arrest robertHENDERSON, Ky. (3/13/13) – A 21-year-old Henderson man who allegedly drove to a restaurant to report that two male subjects beat him up and took his wallet and cell phone at Atkinson Park some time after midnight last night was charged with DUI. Authorities said the victim, Robert Swearingen, told them that the incident occurred in the skate park area of Atkinson Park. Following the assault, he then allegedly drove to McDonald's on U.S. 41 North to report the robbery to police, authorities said.

He did not require medical attention as a result of the robbery. The robbery investigation is ongoing. Robbery 2nd Degree is a Class C Felony.

Swearingen was subsequently arrested for DUI and lodged at the Henderson County Detention Center.
