MADISONVILLE, Ky. (8/11/14) — A Madisonville woman was charged for spitting and kicking at police while she was being placed under arrest when she was found lying against a fence late Saturday night along Noel and Brown Lane in Madisonville.
According to a Madisonville Police Department report, officers Russell Nichols and Andy Rush responded to a complaint of a woman in the street at about 10:55 p.m. Aug. 9. Upon arrival, they found Marian Montoya, 47, Madisonville, to be very intoxicated. As Rush attempted to place Montoya under arrest, he reported that she balled up her fist and rolled to her back. Then, Montoya attempted to kick Rush.
The report said that after Montoya was pepper sprayed, she threatened to kill the two officers. While Rush was leading Montoya to the patrol car, she turned and spit on Nichols twice. After being placed in the car, she attempted to kick and spit on Nichols again, according to the report.Montoya was charged with alcohol intoxication in a public place, first and second offense; resisting arrest, third-degree terroristic threatening; menacing; and third-degree assault/police officer.
