Atwell is charged with taking a smart phone belonging to Tracy Brown from the property at 70 Wharton Road on May 21, 2012. The phone was later located at a pawn shop in Christian County. It is also alleged that Atwell entered the residence at 70 Wharton Road on the same date and attempted to take a flat screen TV but was encountered by the homeowner. Subject then left the residence.

Atwell agreed to turn himself into the police on June 7 to be served with the warrants. The report states that Atwell never showed up and went into hiding. Cadiz Police were actively searching for Atwell at several residences in the city and county during this time.

On Sunday, Cadiz Police received an anonymous citizen tip that Atwell had returned home. He was located and arrested without incident. Atwell was also served a Trigg County Circuit Court arrest warrant for violating his probation and missing a court appearance. Atwell was on probation for a felony theft charge stemming from a 2011 arrest. Atwell also missed a court appearance in Trigg County District Court while he was in hiding and a warrant was issued for his arrest.

Atwell was lodged in the Christian County Jail. He is charged with 2nd degree burglary and theft over $500.
