kentucky legislatureFRANKFORT, Ky. (3/20/18) Senate Bill 5 passed the Kentucky House of Representatives with a crushing 97-0 vote. The vote is considered a huge victory for independent pharmacists who claimed that they were not being treated fairly by Pharmacy Benefit Managers. PBMs are hired to reimburse pharmacies to dispense prescriptions for Medicaid patients.

Encouraged by changes in West Virginia and findings in Arkansas, the pharmacies banded together and created an alliance to make changes to the program. The problem was so severe that independent pharmacies with large populations of Medicaid patients were closing their doors.

Today’s vote is not the final action. Because of changes to the original Senate bill, it must go back to the Senate for confirmation and then to the governor for signature.

Dr. Brad Ashby was ecstatic with an email to SurfKY News, “97-0 - This is the most comprehensive PBM legislation in the country.”

Another leader in the alliance was Dr. Gregg Henry with Sacramento Pharmacy. Henry was outspoken about the way his business was being treated and large cuts being pushed on the independents.
